GENERAL TERMS AND CONDITIONS OF USE FRANCEBUS
- Definitions
Benefit : means all the Services whose performance is assumed by FRANCEBUS under this Contract, as provided for in the Quote.
Service : designates all the services offered by FRANCEBUS relating to the transport of people.
FRANCEBUS: refers to the simplified joint-stock company (SAS) FRANCEBUS, registered with the RCS of Antibes under number 520 920 521 00066, with a share capital of €16,500, whose registered office is located at 2208 route de Grasse – 06600 ANTIBES, represented by its President France CAP (SIRET n°882 151 335 00024) itself represented by its President, Mr. Fabrice Dessaint, publisher of the Site.
Site : means the FRANCEBUS website accessible at the following address: https://francebus.com/ as well as the FRANCEBUS-WEDDING website accessible at the following address: https://francebus-wedding.com.
The User : refers to any visitor to the Site, professional or private, whether or not a FRANCEBUS customer.
- Object
These Terms and Conditions of Use define the conditions of access to and use of the Site.
- Acceptance of the General Terms and Conditions of Use
By accessing or using the Site, the User accepts without reservation these General Terms and Conditions of Use of the Site (hereinafter "GTC").
FRANCEBUS reserves the right to update these Terms and Conditions at any time and without prior notice.
When using the Site, the User is required to regularly refer to the latest version of the Site's Terms and Conditions.
If the User does not accept the changes made to the Terms and Conditions, they must cease all use of the Site.
- Information available on the Site
The Site aims to present FRANCEBUS and its range of Services and Benefits.
FRANCEBUS makes every effort to provide complete and verified information, within the limits of its own knowledge or the information made available to it.
FRANCEBUS may modify the information contained in this Site relating to Services, Benefits, publications, technical specifications or rates at any time without prior notice.
- Intellectual property
5.1 Copyright
The Site and each of its constituent elements, including texts, photographs, images, icons, sounds, videos, software, databases or data, are protected by intellectual property law.
FRANCEBUS owns all intellectual property rights relating to the Site or its elements.
Any reproduction, representation, modification, transmission, publication, adaptation or exploitation of the Site or its elements, including documents available for download on the Site, on any medium whatsoever and in any manner whatsoever, without prior written authorization from FRANCEBUS, is strictly prohibited, with the exception of elements expressly designated as royalty-free on the Site.
Non-substantial reproduction or representation of elements on which FRANCEBUS has intellectual property rights is authorized for strictly private and non-commercial purposes.
Authorised reproduction of elements on which FRANCEBUS has intellectual property rights must clearly indicate the source and the name of the author of the reproduced content.
FRANCEBUS reserves the right to pursue civil and criminal legal action, including for infringement, against any person who, directly or indirectly, has infringed its rights.
5.2 Trademark law
Unless otherwise stated, the company names, logos, products and trademarks reproduced or mentioned in the Site are the property of FRANCEBUS or its partners.
Any reproduction of these symbols, without prior written authorization from FRANCEBUS or, where applicable, the holder of the rights relating to these symbols, is prohibited.
5.3 Third party rights
If the User notices that a photograph or any other element for which they hold the rights appears on the Site, they must contact FRANCEBUS by written email addressed to the following address: info@francebus.com.
- Personal data
During their browsing of the Site, the User may be required to provide personal information about themselves.
FRANCEBUS is committed to respecting the information thus submitted and has implemented a Personal Data Charter available at the following address: [link to the Personal Data Charter].
- Cookies
During their first visit to the Site, the User is prompted to install cookies on their connection device.
Cookies are computer files installed on a device's hard drive, used by the Site to send information to the User's browser and allowing that browser to send information back to the Site (for example, a session ID, language preference, or date).
FRANCEBUS may use three types of cookies:
- Mandatory functional cookies, necessary for the proper functioning of the FRANCEBUS Site, applications or services; ;
- Statistical cookies that allow FRANCEBUS to collect information relating to the use of the Site in order to improve the ergonomics and services of the Site;
- Marketing cookies that allow FRANCEBUS to send User advertisements tailored to their interests.
The data generated by Cookies relates to the User's use of the Site.
When the User accesses the Site, a banner appears informing them of the purpose of the Cookies used, the possibility of customizing their preferences and that continuing their browsing constitutes agreement.
The maximum consent period is 13 months and depends on the cookie used. Information about each cookie, its functionality, and its retention period is available on the website, under the "Cookie Settings" tab.
FRANCEBUS reminds the User that it is advisable to regularly delete Cookies from their terminal via their browser and that several options are available for this purpose.
The User can indeed configure the browser of his or her different terminals in order to accept all cookies, or to reject them or to choose which ones he or she chooses to accept or refuse according to the issuer or, on a case-by-case basis, prior to the installation of the Cookies.
Each browser's configuration is different and can be found in the browser's help menu or on its website.
When a user objects to the installation or use of a cookie, an opt-out cookie is installed on their device. Deleting this opt-out cookie will prevent the user's refusal from being identified.
The same applies to consent cookies installed when the user consents to the installation of cookies.
In order for consent settings to be retained, consent or refusal cookies must be stored on the user's terminal.
- Limitation of liability
FRANCEBUS cannot guarantee the accuracy, completeness or timeliness of the information contained on the Site, nor its suitability for the User's needs.
The User is responsible for the use of the information contained on the Site and fully assumes the risks associated with this use.
As such, FRANCEBUS cannot be held responsible for the use made of the information contained on the Site by the User and for any direct or indirect damages resulting from this use.
FRANCEBUS cannot be held responsible:
- In the event of a technical, IT or compatibility failure or problem of the Site with the equipment used by the User;
- Direct or indirect, tangible or intangible damages resulting from the use of the Site, errors, unavailability of information or the presence of a virus on the Site;
- Intrinsic characteristics of the internet, particularly those relating to the lack of reliability and the lack of security of the information circulating on it.
In any event, the User is expressly reminded that he remains responsible for the protection of his equipment and data as well as for the use he makes of the Site and the Products or Services.
- Site Accessibility Abroad
The Site is accessible to any Visitor, who agrees to use it in accordance with these Terms and Conditions.
The Site is accessible from several countries around the world and may contain references to products or services that FRANCEBUS does not offer in the User's country.
FRANCEBUS cannot under any circumstances be required to offer these products or services in the User's country.
- Hyperlinks
10.1 Hyperlinks to third-party websites
The Site contains links to websites that are not controlled by FRANCEBUS.
The links appearing on the Site are offered as services by FRANCEBUS and the decision to activate them belongs exclusively to the User.
FRANCEBUS is in no way responsible for the content of websites that the User accesses through the Site.
FRANCEBUS cannot be held responsible for any direct or indirect, tangible or intangible damages resulting from the use of the website which the User may have accessed through the Site, from errors, lack of availability of information or from the presence of a virus on this site.
10.2 Hyperlinks to the Site
Any User is authorized to establish a hyperlink on the Site's homepage provided that they do not present the Site as their own, or distort its content, and that the establishment of this link is not carried out for commercial or advertising purposes.
The User is required to inform FRANCEBUS prior to the creation of any hyperlink to the Site by sending an email to the following address: info@francebus.com.
Any link to an internal page of the Site (deep link or deep link) is subject to prior written authorization from FRANCEBUS and must clearly and unambiguously display the URL of the targeted page.
FRANCEBUS reserves the right to remove at any time any hyperlink pointing to its Site if FRANCEBUS deems it inconsistent with its editorial policy.
- Terms and Conditions Update
FRANCEBUS reserves the right to update these Terms and Conditions at any time and without prior notice.
When using the Site, the User is required to regularly refer to the latest Terms and Conditions of Use of the Site, accessible at any time on the Site.
- Waiver and divisibility
The failure of FRANCEBUS to comply with or enforce any provision of these Terms and Conditions does not constitute a waiver of that provision.
In the event that any provision of these Terms and Conditions is declared invalid or unenforceable, FRANCEBUS undertakes to modify that provision in order to make it valid or enforceable, without such modification affecting the other provisions of the Terms and Conditions.
- Applicable Law
These Terms and Conditions are governed by and subject to French law.
Any dispute relating to the conclusion, interpretation, execution or termination of these Terms and Conditions will be subject to an attempt at amicable agreement.
Any dispute arising between the parties as a result of the conclusion, interpretation or execution of these Terms and Conditions shall be resolved by the competent courts determined according to the rules of common law.
