1)    Définition

For the purposes of this contract, the following terms mean:

– “User”: designates any natural or legal person accessing the Francebus.com Platform in order to use transport services by vehicle with driver.

– “Initial pick-up”: the moment when the first passenger begins to board the coach

– “Final drop-off”: the moment when the last passenger finishes getting off the coach.

– “Availability”: The driver makes himself available to the passenger(s) and his guests to drive them. The driver makes as many round trips as necessary during the time slot fixed when booking by the passenger(s), according to prior and initial booking.

2) Application of the general conditions

Francebus.com is a platform for booking and linking users and passenger carriers, specializing in collective passenger transport. Francebus connects anyone (individual or professional) looking for a road transport service with driver from France.

Francebus.com is a brand belonging to Francebus SAS.

Francebus is a Simplified Joint Stock Company with a share capital of 16500 euros, registered with the RCS of Antibes (RCS 520 920 521) whose head office is located at the following address:

The Francebus.com platform allows its users to search for a transport service by vehicle with driver, in particular a transfer service, a single journey, the provision of a vehicle with driver by the day, half-day or evening.

The vehicles are vehicles belonging to carriers chartered via the Francebus.com platform.

Unless otherwise agreed, the fact of reserving a vehicle with Francebus SAS implies full and unreserved acceptance of these general conditions, to the exclusion of all other documents such as prospectuses, catalogs, issued by the company Francebus SAS and which do not only have an indicative value. No particular condition can, except formal and written acceptance of the company Francebus SAS, prevail over these conditions. Francebus SAS reserves the right to subcontract its services to referenced companies.

The reservation of vehicles with Francebus.com entails the customer’s full acceptance of the general and special conditions of sale and the unreserved acceptance of all of their provisions in force on the day of the reservation.

3) Reservation

3.1) formulation of the request by the user

The wording of the user’s request must specify the purpose and characteristics of the expected service such as:

Regarding dates, times and itinerary;
o The date, time, and place of the start and end of the availability of the coach

o The date, time and place of initial passenger pick-up and the date, time and place of their final drop-off

o If applicable, the date, time and location of intermediate stopping points;

o If applicable, the imposed itinerary. Compliance with an arrival time for a connection must be the subject of a stated requirement of the instructing party.

Regarding the composition of the group to be transported
o The maximum number of people making up the group.

o The maximum number of people with reduced mobility, including the number of people in wheelchairs.

o The maximum number of people under the age of eighteen in the context of public transport for children and the number of accompanying persons.

Following this request, Francebus.com will offer its users an estimate that best meets their requests, and specifies the amount of the transaction. The user remains free to accept or not any offer of services which will thus be proposed, according to his own objective criteria (deadlines, geographical area, prices).

The reservation is accepted by Francebus.com within the limit of available places and subject to payment of a deposit at the time of validation of availability.

Advance reservations for transportation services must be made. Without a quote or order form signed by the user and without return and validation by Francebus.com, no reservation will be taken into account.

3.2) booking confirmation

For a final confirmation, the user must return the order form or estimate with:

– stamp, date, signature with the mention “good for agreement” and address for issuing the invoice

– pay a deposit of 50% of the total amount at the time of the order, and the balance before delivery, by any possible means of payment.

– leave the details of a bank card as a guarantee.

– specify the contact details of a person in charge on site, the number of people, the place(s) of pick-up and drop-off, the detailed program of the trip. In the event of missing or erroneous information, Francebus.com cannot be held responsible for a breach of its transport service, and no compensation or indemnity can be requested.

Note for Monaco: coach traffic in Monaco is highly regulated. Pick-ups on the Place du Casino are prohibited (unless authorization is requested in advance from the Hôtel de Paris). Pick-ups and drop-offs are only at hotels, at the Grimaldi car park and at the fishermen’s car park.

4) Applicable law

This contract is subject to French law.

5) Benefits

5.1) Transfers

Any movement from point A to point B, along a specific route.

5.2) Driver at disposal

Platform users have the option of booking a vehicle with driver for a defined time and route. The times chosen include waiting for the driver. These transports are suitable for private, business, event and leisure contexts.

These daily rentals are fixed prices, defined according to a time / distance traveled ratio.

Different packages are possible and adaptable, the most common being for example:

Half-day pass: 4 hours (e.g. from 8:00 a.m. to 12:00 p.m.)
Day pass: 8:00 a.m. (e.g. from 8:00 a.m. to 4:00 p.m.)
Evening package: 5:00 a.m. (e.g. from 7:00 p.m. to midnight)

5.3) Excursions Tours

Organization of transport according to a circuit defined by the user at the time of booking. The ability to change the route en route is not possible.

6) Rates Prices

The fares charged by Francebus.com are fixed fares or packages.

They vary according to the duration, the distance of the journey, and the schedules.

They can be consulted at any time on request. They are also published on the platform as an indication in the form of a flat rate and the price of the trip is communicated when booking by our teams.

No dispute concerning the price of the stay can be taken into consideration after the acceptance of the estimate by the customer. It is up to the customer to assess, before the conclusion of the contract, whether the price suits him by accepting the principle that it is a fixed price.

Are included in the prices:

Vehicle with driver (subject to availability when booking)
Motorway tolls
The prices communicated include VAT at the rate set by the regulations in force for transport services on the day of the race.

Not included in the prices:

-Airport or station taxes
-Additional hour: €90 (daytime) – €100 (nighttime between 9 p.m. and 6 a.m.) in the event of a delay in the user’s initial reservation
-Unlimited “persons transported” insurance, according to the insurance conditions of the chartered carrier at the time of transport
-The mileage of the roadmap according to the route booked
-Carbon offsetting.
-Parking fee
-Meals for the driver(s) if the journeys take place between such and such time during the day, and such and such time for the night.
-Any paid entry not mentioned in the package, any unplanned tolls, the driver’s overnight stay and the meal for the driver(s) during an à la carte trip if the trips take place between such and such a time, miscellaneous disbursements and services to order.

*In fact, you can benefit on board, on request, from additional services such as:

Drinks available, mineral water, soft drinks and fruit juices.
Press, newspapers, magazines
Catering; breakfast or meal tray, prepared by a quality caterer.
Guidance in the language of your choice
Airport/station assistance, a hostess will welcome passengers and lead them to the coach.
These “plus” services are extra, and on request expressly notified at the time of booking.

7) Payment terms

The customer can choose to pay by bank transfer or by credit card.

Regarding late payment penalties

Invoices are established according to the conditions of sale. No discount for early payment. Any amount not paid on the due date automatically entails, from the day following the payment date, the application of late payment penalties at the rate of 18% and fixed compensation of €40 for recovery costs.

Confirmation and deposit

The collective ticket and then the invoice have the value of a ticket and confirm the reservation.

All payment must be settled before the service unless waived.

For long-term and event-driven services, split or end-of-month payment is authorized with deposit, the balance is paid on the dates agreed between the parties.

8) Postponement or cancellation

Any total cancellation must be notified at least 24 hours before the start of the service. Where applicable, Francebus SAS reserves the right to charge cancellation fees:

-7 to 30 days before departure: 30% charge

-6 to 4 days before departure: 50% of the invoice

– 72 hours before departure: 100% charge

The right of withdrawal does not apply to transport services (article L121-20-4 of the Consumer Code). Thus the customer does not benefit from any right of withdrawal.

Similarly, if for any reason whatsoever, the customer cancels his reservations on site, no refund will be granted.

Account creation fees are non-refundable. In the event of payment by credit card, and in the event of cancellation and reimbursement of transport services, fees equivalent to 3% of the amount reimbursed will be retained, equivalent to processing fees and bank charges.

9) Terms of Carriage

9.1) Vehicle characteristics

Each vehicle made available to the user by a carrier chartered by Francebus.com must be:

– in good working order and comply in all respects with technical and regulatory obligations;

– adapted to the distance to be covered, to the characteristics of the group and to the possible requirements of the client

– compatible with the weight and volume of the luggage provided.

Passengers are responsible for any damage caused to the vehicle by their actions. Thus, any damage inside or outside the vehicle caused by one or more passengers will be charged to the user.

9.2) Working conditions applicable to coach users

We ask our kind customers to take into consideration, for the realization of their trips, the information below relating to the working conditions applicable to coach drivers:

The maximum driving time for a driver must not exceed 4h30, beyond that, a stop of 45 minutes must be respected or during the 4h30, 45 minutes in 2 periods: obligation to make a stop of 15 minutes then a stop of 30 minutes, (the order to do 15 minutes then 30 minutes is imperative).
The maximum authorized daily driving time must not exceed 09:00 per working day. In addition to the mandatory downtimes mentioned in the 1st paragraph, a daily rest of 09:00 consecutive hours must be observed.
The daily working time cannot exceed 12:00 a.m. overall (departure from depot / return from depot).
For any excess of amplitude, a second driver is compulsory to overtake the 1st driver within the limit of 18 hours. A supplement will be charged.
A weekly rest must be observed after 6 consecutive days of work.
During stays, this weekly rest cannot be less than 24 consecutive hours.

Consequently, we ask our customers, when carrying out the trip, to take these regulations into account in order to comply with the legislation. Any control on the road by the gendarmerie or the transport labor inspectorate may result, if these regulations are not respected, in the immobilization of the coach and its driver. In addition, in the event of a serious breach, the responsibility of the user of the platform will be engaged.

10) Benefits

All the services and activities described on the Francebus websites, brochures and documents are mentioned for information only and Francebus cannot be held liable in the event of modification after they have been drafted by Francebus.

In addition, any service reserved and not consumed, totally or partially, cannot give rise to any refund, for whatever reason.

The activities and excursions reserved by the customer are carried out by independent local service providers who are solely responsible for their organization.

11) Liability

Francebus.com cannot be held responsible for any dispute, incident or accident occurring during the performance of these services.

Francebus.com can not replace the individual responsibility of each of the participants in the trips.

Francebus.com acting as an intermediary between, on the one hand, the user and, on the other hand, various service providers (carriers, tour operators etc.), it cannot be confused with the latter which, in any event , retain their own liability.

Francebus.com cannot be held responsible and liable for any compensation in the event of cancellation or change of dates of stays.

Any trip interrupted or shortened or any service not consumed by the customer, for any reason whatsoever, will not give rise to any reimbursement or compensation.

All special requests (wheelchair, excess luggage, special meals, transport of musical instruments, etc.) must be sent in writing to Francebus.com, which will endeavor to satisfy any request of this nature by intervening with the supplier of the service. aimed.

However, Francebus.com cannot under any circumstances be held liable for any damage that may result from the failure to take into account a special request.

12) Claims & Customer Relations Service

In the event of a dispute relating to the interpretation or execution of their agreements, the parties will seek, before any legal action, an amicable agreement and will provide each other with all the necessary information for this purpose. This clause applies even in the event of summary proceedings, incidental claims or multiple defendants or warranty claims, and regardless of the mode and terms of payment. These general conditions are subject to French law. In the event of a dispute, the Courts of Antibes will have sole jurisdiction, even in the event of summary proceedings, incidental claims or multiple defendants or warranty claims.

13) Protection of privacy

The personal information collected by the Francebus SAS teams is necessary to process the request for the provision of services. 14) Insurance

In accordance with the regulations, Francebus.com has insurance covering its professional liability, but it cannot replace the individual civil liability of the participants in the trip. In addition, it is desirable to have a multi-risk guarantee covering the costs of cancellation, repatriation, illness, travel accidents.

It should be noted that as an intermediary, the insurance covering the passenger(s) is the carrier’s insurance, chartered by FranceBus.com according to the user’s request.

It is up to the travel participants to check the risks for which they are covered. Once the insurance has been taken out, no modification of the contract can be made. The customer will receive an extract of the general warranty conditions upon registration. When cancellation insurance is taken out, it is up to the participants to inform the insurer directly of the cancellation or any other claim under the conditions and within the time limits indicated in the insurance contract.

15) Transport regulations and customer obligations

For your safety and comfort, please read the following legal provisions. Drivers of public transport vehicles are subject to French regulations and to C.E.E. regulations, which set the working conditions, in particular the driving times and compulsory rest periods:

AMPLITUDE: Maximum 12 hours. The amplitude is the time between the start time and the end of service time. A rest of at least 8 consecutive hours must be respected with a new amplitude of work.

DAILY DRIVING HOURS: 9 hours maximum, with the possibility twice a week of driving up to 10 hours.

CONTINUOUS DRIVING DURATION: The Driver may not drive more than 4.5 hours without a break.

MANDATORY DRIVING INTERRUPTIONS: A 45-minute break must be taken after a continuous driving period of 4.5 hours. ).

DAILY REST TIME: 11 consecutive hours between two working days, if the rest is taken at home and 9 hours if it is taken outside. It can also be split with a period of at least 8 consecutive hours and 4 hours taken by period of at least 1 hour (12 hours in total).

The Principal or customer will be held responsible for non-compliance with the texts (decree n°92.699 of July 23, 1992), since he is required to check that the driving times can be scrupulously respected. Any infringement may be prosecuted under “PENAL”, and in the event of a check, any overrun may be penalized for immobilization of the vehicle on the spot.
